What is a Will?

A will is a very important document that states how an individual desires how his or her property will be disposed of after death. It is essentially a person's directions on how the property is to be divided and to whom it will pass. A will also includes the names of potential guardians of any minor children of the testator (person signing the will). The will also states the name of the person or persons who will be appointed as personal representative, also referred to as executor or executrix in some states. The personal representative acts in what is called a fiduciary capacity. A person's will should be kept in a safe place where it can be obtained immediately after death.
